GENERAL CONTRACTING CONDITIONS

ACCEPTANCE OF THE CONDITIONS
1. These general contracting conditions (the "General Conditions") regulate the sale by BEATRIZ TEROL, with registered office at C/ Claudio Coello, 102, 28006 Madrid and C.I.F. number N50758183 (hereinafter, BOJ WOMAN) to the Customer (the "Customer" or "User") of the products offered by BOJ WOMAN through its online store https://bojwoman.com/ (hereinafter, "the Website") in accordance with the provisions of its product catalog.

2. For the purposes of these General Conditions, the products are intended exclusively for the Customer or User (understood as a natural person over eighteen (18) years of age or a duly represented legal entity), acting as the consumer or final recipient. Any professional resale or distribution of the purchased products is prohibited.

3. These General Conditions shall apply to each and every purchase made by the User through the Website (https://bojwoman.com/). The user acknowledges that they have the legal capacity to oblige themselves and purchase the products and agrees to be bound by the provisions of these General Conditions.

4. These General Conditions shall be supplemented and added to any Specific Conditions established, where applicable, and shall also bind the user to the Terms of Use and Privacy Policy of said Website.

2. PURCHASE PROCESS: ORDER AND ACCEPTANCE

1. Users (registered or acting as Guests on the Website) may place an order through https://bojwoman.com/. Users who order a product through the Website declare that they have full authority to enter into and use any of the payment methods offered through the Website.

2. To proceed with the purchase of a specific product, the user must select the product they wish to purchase, then indicate the desired quantity and add it to their cart.

3. Once the product has been added to the cart, and if they have a discount coupon, the user can add the coupon code and update their cart to determine the purchase price.

4. Similarly, on the right side of the screen, the user will see an estimate of the shipping costs for their order. The estimate that will initially appear in this phase of the purchase will always be for shipping to Madrid. However, in the next phase of the purchase process, these costs will be updated based on the location to which the order must be shipped.

5. In this phase of the purchase process, users with a Gift Card may also enter the code to complete their purchase.

6. Next, the User must click the "Complete Purchase" button. At this point, a new phase of the process will open, in which they will be asked for the necessary information to complete the shipment and determine the details of the invoice that BOJ WOMAN must issue. The user must complete the shipping form, providing the following personal information (those marked with an asterisk are mandatory): first name *, last name *, company name (optional), country *, street address *, house number and street name, apartment, room, staircase, etc. (optional), postal code *, town/city *, province *, telephone number *, and email address *.

7. At that time, the user will also have the option to create an account so that in future accesses, they can be identified by entering their password without having to re-enter all the shipping information, thus simplifying the purchasing process.

8. Creating an account will require the user to enter a password.

9. The use of the password is personal and non-transferable; its transfer, even temporarily, to third parties is not permitted. The user agrees to use it diligently and keep it secret. They must change it as soon as they become aware of or suspect any misuse of it. Therefore, they assume full responsibility for any consequences that may arise from sharing said password with third parties.

10. The user also agrees not to use false identities or impersonate others when using the Website, including, where applicable, the use of third-party passwords or access keys, or in any other way.

11. The user will also have the option at this stage to add a shipping address other than the primary address (which will be the billing address) and to add a special note for the delivery (clarifications or specific requests).

12. Once such information has been completed, the total shipping costs to the address provided by the User will appear separately from the price and before confirming the order on the right side of the screen. The User agrees to provide a delivery address for the order that allows delivery within normal delivery hours. If the User fails to comply with this obligation, BOJ WOMAN will not be liable for any delay or inability to deliver the requested order.

13. The User will have the option to request in-store pickup of their product by checking the box provided for this purpose. In this case, BOJ WOMAN will reserve the product for one week from the date of the online purchase. If this period elapses without the product being picked up, BOJ WOMAN reserves the right to cancel the purchase and refund the amount.

14. The User will validate the order once they have made the corresponding payment, as established in point four of these terms and conditions. The validation of the order by the customer expressly implies knowledge and acceptance of these general contracting conditions as part of the conclusion of the contract, which must be expressly accepted by checking the corresponding box prior to placing the order.

15. BOJ WOMAN will archive a copy of the transactions made with users through an electronic document which, unless proven otherwise, will constitute proof of the effective execution of said contract.

16. Once the purchase has been made and validated, and within a maximum period of ten (10) business days from the date of the purchase, BOJ WOMAN will send the purchase receipt via email.

17. Order confirmation does not imply final acceptance: each order is subject to product availability verification procedures. In accordance with these procedures, BOJ WOMAN will have a maximum period of ten (10) business days from the date the order is placed to inform the Customer of its final acceptance. In the event that a product is unavailable, BOJ WOMAN may offer the option to reserve it or make a pre-purchase purchase (informing the user of the estimated receipt and delivery period for the product) or reject the order due to lack of availability.

18. Once the sales process is completed, BOJ WOMAN will provide the Customer with confirmation of the purchase and the accepted and applicable conditions, thus formalizing the contract between the parties. This confirmation will be sent by email, which will include the applicable conditions.

3. PRODUCT CATALOG: FEATURES AND AVAILABILITY.

1. The product supplied by BOJ WOMAN will correspond to the descriptions and specifications contained on the Website at the time the order is placed. Each product will have a product information sheet on the Website, including a brief description, price, and information regarding product availability.

2. The products offered on the Website are valid as long as they remain visible on the Website and are in stock. Each product will display the delivery timeframe for shipment from the warehouse, or if the product is out of stock. These delivery times will always be calculated based on business days.

3. In the event of a product being unavailable after the order has been placed, the user will be informed by email of: a) the new delivery timeframe for the product if it must be replaced due to damage or defects; b) the cancellation of the order if it cannot be delivered under any circumstances, and any amounts received will be refunded.

4. The refund period for this amount will depend on the payment method selected by the user and the terms and conditions of each banking institution.

5. GIFT CARD: The user will have the option to purchase a gift card either through the Website or in-store. The user must indicate the desired value by selecting the amount, which can range from €50.00 to €250.00. Each card will be valid for one (1) year from the date of purchase. The gift card may be sent to the address indicated by the customer in the case of online purchases.

4. PRICE AND PAYMENT

1. The price of the product will be the current price at the time the order is placed and, where applicable, after applying any discounts applicable to users with a specific discount code. The price offered to the customer is the final price, which includes legally applicable taxes and applicable fees as well as any applicable fees as provided in the product information sheet at the time of ordering.

2. Shipping costs must be paid together with the price of the selected product. Shipping costs will be itemized at the time of ordering.

3. In any case, shipping costs are calculated based on the destination entered in the order form and as follows:

Mainland Spain, the Balearic Islands, and Portugal:
Orders equal to or greater than €70.00: Free Shipping.
Orders less than €70.00: €3.90.
Canary Islands and Melilla: €12.00 plus applicable fees.
Europe: €15.00 plus customs fees or applicable fees.
Rest of the world: €50.00 plus customs fees or applicable fees.
4. Customs fees are not included in the price and must be paid by the buyer.

5. Payment for orders placed through the Website may be made by debit/credit card (Redsys system) or through PayPal. For in-store purchases, cash and credit cards are accepted.

6. To proceed with payment, the User must follow each and every one of the on-screen instructions, providing all the information requested to complete the payment.

7. BOJ WOMAN informs the User that payment will be made through the bank's e-commerce payment gateway, which encrypts the data to ensure maximum security. The data provided by the User during payment will not be stored by BOJ WOMAN.

8. If payment is made by VISA or Mastercard, the charge will be made instantly if the card is debit, or at the end of the card's billing period if it is credit. For payments made with cards issued outside of Spain, the issuing bank must comply with the Secure Electronic Commerce (CES) Security Protocol. Payments with cards that do not meet this requirement are not accepted. If, during payment processing, the user is informed of any error that prevents effective payment of the amount corresponding to the requested order, the order will be automatically canceled and the customer will be informed of the cancellation via an error message on the screen.

9. BOJ WOMAN will send, along with the purchased product, a receipt or purchase ticket, which the Customer must retain in all cases to request an exchange or refund. BOJ WOMAN may issue, upon request, the invoice corresponding to the purchase.

10. GIFT CARD: In cases where the User wishes to make a purchase using a gift card, once the User has selected the product they wish to purchase on the Website, they must enter the code in the box created for this purpose and click the "Apply" button.

11. For the purchase to be valid, the value of the gift card must be equal to or greater than the value of the product purchased. In cases where the value of the gift card is greater than that of the product, the amount of the purchased product will be subtracted from the total value of the card. The user may use the remaining amount available on their gift card until the expiration date applicable to said gift card.

12. DISCOUNTS: BOJ WOMAN may offer discounts to customers and users on certain dates, for certain products, or as a direct consequence of a specific action by the User.

13. In such cases, the validity of the discounts will be linked to compliance with the conditions applicable to each type of discount, which must be specified at the time the discount is advertised.

5. PRODUCT DELIVERY

1. The products will be shipped by courier to the shipping address indicated in the order within five to seven business days from the date the order is placed, during business hours Monday through Friday, from 10:00 a.m. to 2:00 p.m. Orders placed outside of these hours will be processed the following business day.

2. Products will not be delivered to PO boxes or public places.

3. The user will receive an email from hello@bojwoman.com specifying the expected delivery date. In any case, it is important that the user has provided their contact telephone number in case the company in charge of managing the shipment needs to contact them at any time.

4. Estimated delivery times are as follows:
Spain – between 5 and 7 business hours
Europe – 12 business days
Rest of the world – 30 business days
5. During special promotional periods and Christmas, delivery dates may be extended.

6. IMPORTANT: Pre-order orders (pre-order) will arrive within the date range specified in the item's description.

7. The product will be delivered to the Customer as indicated, and the Customer must sign the delivery note upon receipt.

8. If an order is placed for multiple items with different availability, BOJ WOMAN will split the order, sending the available items and postponing a second shipment for any unavailable items. In this case, the second shipment will be made at no additional cost.

9. It is the user's responsibility to check the status of their order at the time of delivery and then make any appropriate claims. They also have the option of rejecting the package if it has been opened or if it shows obvious signs of damage.

10. If the Customer detects any problem upon delivery of their order (damaged packaging, missing or damaged products), they must indicate this in writing on the carrier's delivery note and contact our Customer Service Center at hello@bojwoman.com within a maximum of three (3) calendar days from receipt of the order, indicating in the subject line "Product return due to delivery defects" followed by the order identification number. No return of damaged items, nor claims for missing items, will be accepted if this has not been reported within the established timeframe and as established.

11. The product will be deemed to have been delivered to the Customer's satisfaction when the Customer accepts receipt of the product. At the time of delivery, the Customer will examine the product, verifying its quantity, condition, and integrity to their satisfaction, and accepting it by signing the corresponding delivery note, which will constitute their express waiver of any subsequent claims.

6. RIGHT OF WITHDRAWAL

1. BOJ WOMAN recognizes the Customer's right of withdrawal, which may be returned within a maximum period of thirty (30) calendar days from the date of physical receipt of the product.

2. The right of withdrawal may be exercised by written communication via email to hello@bojwoman.com with the subject line: "Product return due to withdrawal" followed by the order identification number.

3. Requests that are not exercised through the indicated procedure will not be honored.

3.1. The refund will include the full purchase price. The refund will be made through the same payment method with which the product was purchased. BOJ WOMAN informs you, in all cases, that the direct costs of the return will be borne by the Customer requesting it.

3.2. The Customer must return the products subject to withdrawal without undue delay within a maximum period of fourteen (14) calendar days from the date on which they notify BOJ WOMAN of their decision to withdraw. The refund of the withdrawal amount will be made within fourteen (14) calendar days from the date on which the decision to withdraw from the contract was effectively and unequivocally communicated, provided that BOJ WOMAN has previously received the product. Otherwise, the refund may be withheld until receipt of the product or until the Customer provides proof of its return.

3.3. In any case, for the purposes of exercising the right of withdrawal, the product must be returned in its original packaging along with the invoice. Before returning the product, the Customer must ensure that it is properly protected and sealed to prevent any damage during transport.

3.4. BOJ WOMAN will provide the Customer with a template form for exercising the right of withdrawal.

7. EXCHANGES AND RETURNS

7.1. EXCHANGES: The Customer may request an exchange of size or model within 15 days of receiving the product.

In such case, the Customer must follow the following process:

Place the product they wish to exchange in the box.
Items must be sent in their original condition, including the box and cloth bag, with no signs of use or damage. Otherwise, the product exchange will not be accepted.
Include the order details (name and surname, order number, and specification of the product and size for which you wish to exchange) in the shipping box.
Send the package to the BOJ WOMAN store located in Madrid or go there in person to make the exchange (Claudio Coello 102, 28006 Madrid. Hours: Monday to Saturday, 10:30 a.m. to 20:30 p.m.).
BOJ WOMAN will not be responsible for the shipping costs of the exchanged product to the store. However, it will cover the shipping costs of the new product to the user, provided that the shipment is within the Iberian Peninsula or Portugal. All other shipments must be paid by CLIENT.

The customer will be solely responsible for the condition of the product until it has been duly received at the BOJ WOMAN warehouse.
Once the package has been received, the requested exchange will be processed as long as the product is in stock. If this is not the case, the customer may choose between a refund of the corresponding amount or an exchange for a new design of the same price. (In cases where the user opts for a new design of a different price than their initial purchase, BOJ WOMAN will refund the full initial purchase price, and the user must make a new purchase to receive the new product.)
7.2 RETURNS: The customer may request a return of the product within a maximum period of 30 days from receipt of the purchase.
In such cases, the customer must follow the following process:

Place the product they wish to return in the box.
Items must be sent in their original condition, including the box and cloth bag, with no signs of use or damage. Otherwise, the return of the product will not be accepted.
Enter the order information (name, surname, order number, product specification, and reason for returning) in the shipping box.
Send the package to the BOJ WOMAN store located in Madrid or visit the store in person to process the exchange (Calle Claudio Coello 102, 28006, Madrid. Hours: Monday to Saturday, 10:30 a.m. to 8:30 p.m.).
BOJ WOMAN will not be responsible for the cost of returning the product to the store.
The customer will be solely responsible for the condition of the product until it has been duly received at the BOJ WOMAN warehouse.
BOJ WOMAN reserves the right to reject returns communicated or sent outside the established deadlines, or for items that are not in the same condition as when received.
Once the package is received, the product's condition will be checked and, if it is in perfect condition and unused, the return will be authorized. BOJ WOMAN will then send the customer a confirmation email indicating the amount to be refunded, which will correspond to the price initially paid for the product.
Refunds will always be made through the same means of payment as the original payment.
In cases where the purchase was made in cash, the customer must contact the Madrid store to request a refund. In special cases, BOJ WOMAN may determine alternative methods for processing the refund.
In cases where the purchase was made by bank card, the refund will be made to the same bank card used to make the purchase. The time it takes for the payment to be processed by BOJ WOMAN will depend on the bank holding the card, with a maximum of 14 days from the date BOJ WOMAN requests the refund. Any international fees arising from the transfer will be borne by the beneficiary and customer.
In cases where the purchase was made using a gift card, BOJ WOMAN will issue a new card or refund the corresponding amount.
During sales periods, BOJ WOMAN reserves the right to make changes to the terms and conditions for product exchanges and returns. The terms and conditions applicable to these periods will be available to the user at the relevant times through the Website and/or in the BOJ WOMAN store.

8. WARRANTY
If the Product presents any defects and/or does not comply with the manufacturer's specifications, the Customer may opt for a free replacement or repair.
BOJ WOMAN products are handcrafted from leather, so they may often exhibit the characteristics and variations typical of the natural materials used in their manufacture. These variations will not be considered defects or flaws.
BOJ WOMAN will replace or repair the product provided that:
The Customer notifies BOJ WOMAN of the defect in writing by email to hello@bojwoman.com, within a maximum of seventy-two hours (72 h) from receipt of the product in the case of an online purchase, or from the date of purchase in the case of an in-store purchase.
It is proven to BOJ WOMAN's reasonable satisfaction that such defects are caused exclusively by manufacturing or storage defects and are not due to irregular use of the product.
The product is delivered to BOJ WOMAN if requested.
Once the customer's email is received, By explaining the defect or problem with the product in question, BOJ WOMAN will carefully examine the returned product and, within a maximum period of seven (7) business days, will notify you by email whether a refund or replacement is appropriate, and, if so, how to proceed with the return of the product.
The refund or replacement of the product will be made as soon as possible and, in any case, within the timeframes and through the means specified in point 7 above.

9. LIABILITIES: LIMITATIONS and EXEMPTIONS

1. Except as expressly provided otherwise in these General Conditions, BOJ WOMAN's liability in relation to any product shall be strictly limited to the purchase price of that product.

2. BOJ WOMAN shall not be liable for any failure or delay in the performance of any of its obligations under these General Conditions caused by events beyond its reasonable control ("Force Majeure Event"). Force Majeure Events shall include any act, event, failure to perform, omission, or accident beyond our reasonable control, including, but not limited to, the following:

Strikes, lockouts, or other industrial action.
Fire, explosion, storm, flood, earthquake, subsidence, epidemic, or any other natural disaster.
Inability to use trains, ships, aircraft, motor transport, or other means of transport, whether public or private.
Inability to use public or private telecommunications systems.
Acts, decrees, legislation, regulations, or restrictions of any government or public authority.
3. BOJ WOMAN's obligations under the Contracts shall be deemed suspended for the period in which the Force Majeure Event continues, and it shall have an extension of the time to perform such obligations for a period equal to the duration of the Force Majeure Event. BOJ WOMAN shall use all reasonable means and diligence to attempt to perform its obligations despite the Force Majeure Event.

10. DATA PROTECTION
In accordance with personal data protection regulations, we inform you that the data voluntarily provided by the user will be processed by BEATRIZ TEROL, with registered address at C/ Claudio Coello, 102, 28006 Madrid, and CIF number N50758183, for the purpose of managing the purchase agreement between the parties. This will include identifying you, carrying out all necessary steps to complete the purchase process for the selected product, managing the shipment of the product, managing possible exchanges or returns, conducting satisfaction surveys, etc.
2. The legal basis for processing the data of users who make a purchase on the Website is the execution of the purchase agreement that binds both parties. Conducting satisfaction surveys is based on the legitimate interest of BOJ WOMAN. This data will be processed for the time necessary to process the purchase of the products or services acquired, including any returns, complaints, or claims associated with the purchase of the specific product or service, and for the periods required by applicable law.

3. Within the framework of this contract, and for the purposes set forth above, the Client expressly authorizes BOJ WOMAN, for the purposes set forth above, to disclose their data to financial institutions, fraud detection and prevention entities, technology service providers, logistics, transportation, and delivery service providers and collaborators, customer service providers, and, in general, to those providers whose intervention is necessary to complete the product purchase and shipping process.

4. The Client may exercise their rights of access, rectification, erasure, portability, and restriction or objection to processing by writing to BOJ WOMAN's registered office or by sending an email to hello@bojwoman.com, attaching a copy of their ID or other identification document. Likewise, you may request to withdraw the consent given and file a complaint with the Supervisory Authority (Spanish Data Protection Agency www.aepd.es).

11. MISCELLANEOUS

1. Each Party acts in its own name and on its own behalf.

2. Neither Party may assign its rights, interests, obligations, or responsibilities acquired by accepting these General Conditions or delegate such responsibilities without the prior written consent of the other Party.

3. These Terms and Conditions are written in Spanish. In the event of any discrepancy between the Spanish version and any translated versions of these Terms and Conditions, the Spanish version shall prevail.

4. If any wording or clause of these General Conditions is deemed invalid, illegal, or unenforceable for any reason, this will not affect the validity of the remaining clauses.

5. No amendment or modification to these General Conditions will be valid without the written acceptance of BOJ WOMAN.

6. BOJ WOMAN may modify the General Conditions at any time. Any modifications made will not affect previously made purchases. BOJ WOMAN will notify you of any modifications to the General Conditions prior to the effective date of the new text.

12. APPLICABLE LAW AND JURISDICTION

1. These General Conditions are subject to Spanish law. The Customer, as a consumer, will not be affected by any rights granted to them under current legislation.
